Terms of use
The terms for using the BiteFresh app and BiteFresh Premium.
§ 1 Scope & provider
These terms of use govern use of the “BiteFresh” app (also called “FreshBite”). The provider is Kadiza Designs, owner Sabrina Ramona Valentini Thys, Holter 22, 59269 Beckum, Germany, email: [email protected] (a small business under Section 19 UStG). By registering or using the app, you agree to these terms (incorporation under Sections 305 et seq. BGB). The version available in the app at the time applies.
§ 2 Service description
BiteFresh is a local-first app for managing food stock, shopping lists, recipes and a household budget. An account is required; sync, households and shared lists use server features. The app is continually developed and provided “as is”; a particular range of features or uninterrupted server availability is not guaranteed. BiteFresh can optionally be connected to Amazon Alexa. The Alexa skill supports German queries and individual stock and shopping list changes. Recording a pack as consumed or spoiled requires your explicit confirmation. Deleting whole products, managing households and clearing a shopping list remain app-only actions. The voice assistant itself is an Amazon service; we are not responsible for its availability or recognition quality.
§ 3 Registration & account
Using the app requires registration and an account (an email address with confirmation, or sign-in through Google/Apple); core features remain available on the free plan. Your information must be accurate, and you must keep your credentials confidential. You are responsible for activity through your account.
§ 4 Minimum age
You must be at least 16 years old to use the app (Article 8 GDPR). Younger users may use it only with the consent of their parent or guardian.
§ 6 Content shared by users (community)
Some features anonymously share content with the community to make it more useful for everyone (for example, average prices, consumption rates, named barcodes/products and — if you enable it — shared recipes). For these contents, you grant Kadiza Designs a non-exclusive, royalty-free right, unlimited in territory and time, to provide, display and aggregate them in the app. You confirm that you are entitled to share them and do not infringe third-party rights.
§ 7 Conduct & moderation
We have a zero-tolerance policy towards unlawful, insulting, misleading or offensive content. You agree not to submit such content. You can report displayed community content using the “Report” feature. We may remove reported or prohibited content and suspend users who misuse the service. Contact for reports: [email protected].
§ 8 Important information about shelf life & health
All information about shelf life, best-before dates, use-by dates and whether food is edible is non-binding guidance and does NOT replace your own checks. It is not food law, medical or health advice. You alone decide whether food is still safe to eat, at your own responsibility. AI-powered features (for example, Freshy, recipes and scanning) may contain errors. We accept no liability for damage caused by spoiled food.
§ 9 Liability
We are liable without limitation for intent and gross negligence, and for injury to life, body or health. For a slightly negligent breach of essential contractual obligations, liability is limited to foreseeable damage typical of the contract; otherwise, liability is excluded. No further liability applies.
§ 10 Availability, changes & termination
We may develop, restrict or — with reasonable notice — discontinue the app. You can delete your account at any time (in the app under Profile → Delete account, or alternatively by emailing [email protected]). These terms may be amended when necessary; we inform you of material changes in the app.
§ 11 Final provisions
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods; mandatory consumer protection provisions of your country of residence remain unaffected. If any provision is invalid, the remainder of the contract remains valid. We are neither obliged nor generally willing to participate in dispute resolution proceedings before a consumer arbitration body (Section 36 VSBG).
